- ROME, NOV 7 - The European Parliament on Tuesday called for limits on the ability of EU member states to refuse to recognise the parenthood status established by other European nations, a move that could have an impact on the Italian government's efforts to limit the scope for two members of a same-sex couple to both be registered as a child's parents.
The Parliament's Legal Affairs Committee adopted an opinion on draft legislation facilitating the recognition of parenthood across the EU. The draft law would enable parenthood as established in one EU country to be recognised in order to ensure that children enjoy the same rights under national law in another member state, particularly for custody, maintenance or succession rights.
While parenthood would continue to be established nationally, so member states would not be obliged to change their family law to, for example, accept surrogacy, it would have to be recognised as such in all EU countries irrespective of how the child was conceived, born or the type of family it has.
Premier Giorgia Meloni's Brothers of Italy party has presented a bill to make surrogacy, which is illegal in Italy but used by many gay Italian parents abroad, a"universal crime", while the government has told city councils to stop registering the children of same-sex couples using a procedure based on the transcription into Italian civic registers of the foreign birth certificates of children conceived via surrogacy or assisted fertility, which is only available to heterosexual...
